RESTRICTIONS

The property conveyed herein is subject to the following covenants and restrictions:
L Residential use of the property shall be limited to single family dwellings. No multifamily dwellings will be permitted. This restriction shall not be interpreted as a prohibition of enrolling the property in the Greenbelt or Forestry fax program, as long as the use of the property is otherwise in compliance with these restrictions.
  1. No mobile homes (single wide, double wide, or any other type), modular homes, or prefab homes are permitted, on either a temporary or permanent basis.
  2. All residences constructed thereon shall contain a minimum of 1,800 square feet of heated living space, exclusive of porches, garages and basements. If a two-story house is constructed, the ground floor shall contain at least 1,200 square feet of heated living space. In addition, each residence shall have an attached garage, either on the main floor or in the basement, with a minimum capacity of one (1) car, equipped with a remote controlled garage door opener.
  3. All houses shall be brick or stone to grade. The remainder outside wall surfaces of the house shall be constructed of brick, stone, fiber cement board (i.e. Hardie board), or a combination thereof
  4. Structures commonly referred to as “shop houses” or “barndominiums” are permitted. That portion of the structure used as a residence (“Residential Portion”) shall be brick or stone to grade. The remainder of the exterior wall surfaces of the residential portion shall be constructed of brick, stone, fiber cement board (i.e. Hardie board), or a combination thereof. The remainder of the structure (“Non-Residential Portion”) of the structure shall be brick or stone to grade, For at least 3-feet above grade, the remainder of the exterior wall surfaces of the non-residential poltion shall be constructed of brick, stone, fiber cement board (i.e. Hardie board), metal, or a combination thereof.
  5. Any other outbuildings (including detached garages) and free-standing satellite dishes shall be situated such that no portion of the structure is nearer to the road than the back building line of the residence located thereon.
  6. All construction must be completed within twelve (12) months of beginning construction.
  7. Property owners may keep on the property a reasonable number of domestic pets, defined to be a cat and/or dog. Such domestic pets shall be kept under the control of their owner and shall not be unreasonable in number. Owners may keep a reasonable number of their personal horses and/or cattle on the property if properly fenced.
  8. No commercial activities are permitted on the property, including, but not limited to: commercial swine, poultry, dog kennels, livestock, or other animals. In addition, nothing shall be done on any tract, which may constitute a nuisance or unreasonable annoyance to the other tracts in this development, and the grounds and general appearance of the property must be in keeping with the other tracts within said property.
  9. Tracts may be re-configured, or subdivided, so long as all resulting tracts are at least 5acres in size.
  10. These restrictions shall be applicable only to property conveyed herein, and shall not be extended to any other lands owned by the Grantors, by implication or otherwise.
  11. The covenants and restrictions herein shall run with and bind this land for a term of twenty (20) years from the date this Deed is recorded. The provisions herein may be amended during said timeframe by an instrument executed by ti’act owners representing not less than sixty (60) percent of the tracts subjected to these restrictions, with one (l) tract representing one (l) vote. Any amendment so executed must be recorded in the Registers Office of Robertson County, Tennessee.
  12. These restrictions may be enforced by the Grantors or any person owning an interest in any of the tracts covered by the same. Such enforcement may be by any proceeding at law or in equity against the person or persons violating or attempting to violate any such covenants and restrictions, to enjoin such violation and/or for damages. In the event that legal action is taken to enforce these restrictions, the party found to have violated the restrictions shall be responsible for all reasonable attorney’s fees, court costs, and other reasonable expenses incurred in the prosecution of such action.
